 The Children

 

 


  • Prosecutor begins by describing the three children and their lives.

  • Says the jury will hear difficult evidence and testimony from numerous witnesses.

Events of January 24, 2023

  • Lindsay takes Cora to a doctor's appointment.

  • Patrick stays home with the boys and later works in the basement.

  • Lindsay cares for the children:

  • Puts the youngest down for a nap.

  • Takes the older children outside to play in the snow.

  • Takes pictures to send to Patrick.

  • Patrick describes the day as a good, normal day.

Activity Around 4:00 p.m.

  • Prosecutors point to several searches and phone activities:

  • Searches for MiraLAX following the doctor's recommendation.

  • Looks up a local restaurant and its takeout menu.

  • Uses Apple Maps to calculate the distance and travel time.

  • Calls CVS to confirm MiraLAX is available.

  • Lindsay texts Patrick about getting takeout.

  • She calls the restaurant and places the order.

  • Patrick leaves around 5:15 p.m. to pick up the medication and food.

Prosecution's Timeline

  • Prosecutors argue Lindsay knew approximately how much time she had while Patrick was gone.

  • They allege she took the children to the basement and killed them using exercise bands.

  • They allege she then went upstairs, obtained a knife, and made a brief phone call with Patrick.

Patrick Returns

Discovery of the Children


  • Patrick tells first responders that Lindsay had indicated the children were in the basement.

  • He goes to the basement while remaining connected with 911.

  • He discovers the children and alerts responders.

  • First responders attempt to save them.

Deaths and Injuries

  • Dawson and Cora are pronounced dead at the hospital.

In the jury room (aka my opinion): Personally some of the things mentioned seemed like stuff that could be twisted into meaning other things but overall a decent opening.

Defence

Opening Perspective

  • Acknowledges that the case will be extremely difficult emotionally.

  • Challenges the prosecution's claim that the case is not about women's mental health after childbirth.

  • Argues that postpartum mental health is central to understanding what happened.

Who Lindsay Was Before the Murders

  • She was instead cleared for release on January 4.

January 24

Overall Defence Theory

  • Her symptoms allegedly progressed from postpartum depression and severe insomnia to dissociation, suicidal thoughts, intrusive thoughts, and ultimately psychosis.

  • The defence's central argument is that Lindsay was experiencing a severe psychiatric episode on January 24 and was not acting as the rational, calculated person described by the prosecution.

  • The defence asks jurors to consider the entire progression of her mental illness and treatment—not simply the events of January 24.

  • Ultimately, the defence argues that Lindsay's mental state prevented her from being criminally responsible for the deaths of her children.

In the jury room (aka my opinion): lawyer was passionate, very focused on Lindsay's mental health struggles. Overall pretty standard given the circumstances.

This cases clearly isn't about DID SHE or DIDN'T SHE, the focus is her mental state at the time of the crime.


Witness 1- Patrick Clancy - Called By The Prosecution

Husband of Lindsay Clancy at the time and the children's father


  • Lindsay appears upset and struggling emotionally to look at this witness at times

  • Patrick answers general questions from His name to questions about his a Lindsay's relationship. Answers are very short and to the point

  • He's asked about their first child, he states her name and when asked her birthday, he becomes upset and holding back tears gives the date.

  • Talks about Lindsay's first labour being a difficult one. Shares she had anxiety about returning to work but was able to return and did about 20 hours a week on overnight shifts. a babysitter would then come the following morning so she could sleep.

  • Asked about their second child, once again seems upset as he shares the name and birthdate.

  • Answers question regarding her second delivery, saying it was more traumatic and took a even worse physical toll on Lindsay's body. she in turn took extra weeks off work. he thinks 14 -16 weeks. prosecution refers to evidence to confirm it was actually 18 weeks. At this point Lindsay tell her lawyer something after sitting very still and anxious for the day.

  • Patrick claims she really struggled when it was time to go back to work with anxiety and that she had a really hard time being separated from them.

  • She returned to work on the 20 hrs per week with the babysitter coming so she could sleep. Notes she wasn't on any medications but did see a therapist for a short time.

  • Prosecution asked questions regarding them cleaning out their garage and the process they went through. confirming with Patrick that it was a very organized task.

  • Asked about their 3rd child and the delivery of that child. Patrick says it was better then the first 2 and they both were smiling after.

  • Notes he and Lindsay were on maternity/paternity leave. after 12 weeks he returned to work. Lindsay never did return.

  • says the summer months were busy but good, he'd often handle taking Cora & Dawson, while Lindsay would stay home with callen.

  • testified he noticed some anxiety starting as September drew nearer.

  • Prosecution ask if Patrick noticed any concerning behaviour, was there a ever a time he couldn't understand her or felt she needed to be committed. He says no just a lot of stress.

  • testifies that while he woks in the basement he will come up during lunch to say Hi, if his schedule allows sometimes he would help watch the kids while she ran a errand or went to appointments.

  • Discussed Lindsays schedule to return to work starting at 1 day a week and hopefully moving to two. but also mentioned that they had some savings to allow for financial stability if she needed a bit longer.

  • the older kids were in preschool during the fall 3 full days and 1 half day.

  • they also hired a nanny for about 12 hours a work a week, mainly to take care of callen while Lindsay slept after her shifts. They started her before the anticipated return date to familiarize with the family but ended up having to let her go because Lindsay wasn't going back to work.

  • the kids participated in activities that both parents would take them to.

  • Lindsay was very fit and health conscious, she would go to the gym.

  • Mid sept. Lindsay mentions reaching out to a doctor and psychiatrist and wanting to start zoloft.

  • Observations in October where no real improvements, becoming more depressed. not sure on the exact date she started medication.

  • Lindsay sleep was starting to have her sleep effected and was advised to double her dose.

  • Reports more trouble sleeping and they try sleeping in separate rooms in hopes it helped.

  • Lindsay switched providers because what the first provided recommended wasn't working. looked for a more specialized provider. on the recommendation of his mother .

  • that provider ended up leaving the office and she was transferred to a Nurse Practitioner. she was given new prescriptions

  • acknowledges that he had a bag of 9 medications to dispose of in his truck. most bottles only had a few missing as new prescriptions were given

  • Was on 2-3 medications at a time. visited the hospital in November due to 48 hours of no sleep.

  • The attended a local food event in November as a family and went to her parents house for thanksgiving and the following week to Patricks sisters house where a photo of Lindsay and her 2 sister in laws is taken and Lindsay is smiling.

  • Patrick reports this was a night Lindsay really struggled and was very quiet but managed to still engage with the family and help handle the kids.

  • Prosecution is under the impression from a photo that they went out for their anniversary on Dec 3rd but Patrick shuts that down and said due to how Lindsay was feeling, they stayed home.

  • Confirms that they went and got a Christmas tree as a family around that time.

  • A new medication is mentioned being started in late Nov. / early Dec. This created a big spiral, noticeable weight loss, very depressed mood. mentions she's suicidal but no current plan.

  • A jointly owned tablet is brought into evidence showing previous searches related to suicide

  • Around beginning of dec. she begins expressing intrusive thoughts that she would harm the kids or worried the kids would get very sick/ harmed in another way. Asked if she had a plan and if it was distressing and she said no plan and yes distressing. the thoughts were more that she was worried something would happen to the kids.

  • Her parents begin coming up to help and Patrick asks if she needs to be kept away from the kids, she says no and would continue to care for the kids very well.

  • Mentions being concerned about 10 different medications in 2 months. Recommends see a provider in person instead of tele health.

  • Dec 15th 2022, Lindsay visits Mass. Gen. Emergency due to concerns about suicidal thoughts. She was recommended a Day Program in providence. Still no actual plan at this time.

  • She went to the program and a few hours later she called Patrick and said the doctors wanted to speak to them where they informed them that they didn't think the program was the right fit for her.

  • Lindsay continues to work out weekly throughout December. Taking kids to doctor appointments.

  • They return to the Mass Gen. emergency department on Dec 31, to hopefully get into MacLean Psychiatric Hospital. Exhibits of Lindsay taking a "selfie" at the hospital

  • She was admitted over the course of 5 days, he visited 2-3 times due to restrictions on visitation hours.

  • Patrick felt based off Lindsay's updates that she wasn't really getting any treatment. refers to her colouring and playing with clay.

  • Prosecution implies insurance had nothing to do with decisions to leave.

  • Prosecution says lindsay wanted to go home by a certain date for Cora's birthday. Patrick doesn't remember it that way.

  • SIDEBAR is called- Prosecution is asking for Patrick to identify photos of how his kids looked in January 2023 and talk about what each kid was like- He is very clearly struggling with this.

  • Patrick checks in with Lindsay everyday to see her feelings, she reports no suicidal thoughts or thoughts of harming the kids.

  • The family went to a museum of science jan 8th and photos are shown lindsay interacting with the kids.

  • Another SIDEBAR - In reference to the state wanting to show a video of Cora's Birthday. it's allowed and its a short clip of everyone including Lindsay singing Happy Birthday.

  • Video clips shown of the family at a waterpark. Only short clips are allowed by the judge.

  • testimony about Jan 16th. Patrick and Cora go skiing, he feels comfortable with Lindsay staying home with the two boys and she does. she keeps in contact and can be understood at all times

  • Weekend before the date in question, Lindsay's parents visit. Patrick and lindsay see friends. Patrick reports Lindsay as quiet and down feeling. her mother texted saying she thought she was doing much better.

  • Finally Hit Jan 24th 2023

    • Lindsay takes Cora to the doctors, Patrick stays with the boys. they send photos of the kids to each other.

    • Lindsay comes home, Patrick heads to his office downstairs to work.

    • Lindsay and the kids go outside and build a snowman

    • the couple times he goes up to see them Lindsay seems happy and playing with the kids

    • He reports it as one of her best days

  • 4:53 pm- Lindsay texts Patrick asking if he wanted to do take out because it had been a long day.

  • Prosecution questions why she would suggest 3V restaurant and not one of their usuals that are closer to home.

  • Lindsay places the order at approx. 5:10

  • Patrick comes up kisses the kids and heads out to pick up food.


In the jury room (aka my opinion): Patrick being the first witness really dove right into the case. He kept all answers short and to the point and never gave a feeling that he was out to get Lindsay. He acknowledges her mental health struggles and how they couldn't even get a diagnosis. At time the stuff the state was asking seemed pointless and like it was just being presented to make the jury feel sad. He clearly had times of struggles on the stand especially when remembering the 3 kids. It felt like a type of torture on him. Also the state kept jumping all over in the months of Sept- December which was annoying haha
