Lindsay Clancy Trial - Day 6

Today started off with the judge and lawyers and Lindsay discussing some facts of the case
The defence wanted to stipulate to some evidence

A defendant stipulates to facts to save time, avoid harmful or graphic evidence, and focus the trial on core legal disputes. By agreeing that certain facts are true, both sides skip calling witnesses or proving those points.
The judge asked Lindsay some questions and She confirmed that she understood and voluntarily agreed to a stipulation of facts. this is the first Lindsay has spoken since being arraigned in the hospital if i'm correct
The stipulation included matters involving the chain of custody of evidence and postmortem toxicology findings. Essentially the defence doesn't dispute the evidence and it's given to the jury to review.
Witness #34- Christina Carpio- Called by the prosecution
Trauma surgeon at south shore
Worked with Dr. Kelly McDonough in treating Lindsay the night on the 24th.
evaluated the neck and wrist injuries and decided that the didn't need surgical intervention
Noted the spinal injury but determined it didn't need immediate surgical intervention
Noted hypotension and hypothermia ( stabilized blood pressure and brought her temp to 92.5)
consulted with their neurology department and they recommend she be transferred
Talks about the consultation and decision to transfer Lindsay, Essentially South Shore was equipped for how critical Lindsay's condition was.
witness #35- Joseph Rabbit- Called by the prosecution
Mass. state police
Sent to Beth Israel hospital, to check status on the children and have potential victims documented by crime scene services
Then went to the Clancy home to assist with the execution of the warrant
Found the prescription medication in the cupboard in the kitchen, made sure it was documented in pictures and logged into evidence
received and logged more prescription meds from Patrick Clancy on February 6th 2023 (medications Lindsay was no longer on and he was suppose to take to be destroyed safely)
Witness #36- Maureen Hartnett- Called by the prosecution
Forensic scientist
collected and test biological evidence ( blood , fluids etc)
Questioned on brown stains around the crime scene and on clothing which were blood
Witness #37- Jonathan Oloughlin- Called by the prosecution
State police - crime scene services division
In charge of Photographing, videoing or sketching the crime scene
identified photos of exercise bands, kids clothing, etc.
Witness #38- Hillary Grifiths- Called by the prosecution
Forensic Scientist- toxicology department
Talks about the process the lab uses. Essentially each month a scientist is assigned a specific task and any case needing that test for that month will be done by that one person
different people ran different tests and then it's all combined and written into a report by another person in the lab
confirmation method for benzoazipines on the urine sample and the quantitation method for benzoazipines on the blood sample.
Witness #39-Lisa Yelle- Called by prosecution
State police crime lab- toxicology
Preformed the general unknown screen testing ( tests for perscription meds and drugs of abuse)
was positive for benzos
Facts stipulated into evidence
The parties agree to the following facts
That all postmortem testing and toxicology for Cora, Dawson and Callen Clancy were preformed in accordance to laboratory policy's and procedures.
That tests were preformed batch style meaning different analysis performed different test as assigned and submitted for final report.
Witness #40- Alicia Zimmerman- called by the prosecution.
State police crime lab
She was in charge of compiling the test results and creating reports on Cora, Dawson and Callen Clancy.
Testified that postmortem toxicology found NO substances in their systems.
Witness #41- Sherri Crook- called by the prosecution
State Police Crime Lab- Blood stain Analysis
Discussed how blood stains are analyzed
reviewed pictures of blood stains of the Clancy home
discussed location, appearance and characteristics
Overall Opinion of the Day:
Really with the defence stipulating to some facts they basically aren't denying or questioning any of the evidence or the procedures of collection and testing soooo today seemed like a waste overall. the most important testimony was the trauma surgeon from south shore who helped Dr. Kelly McDonough, seemed more competent but still nothing really enlightening case wise.
