Lindsay Clancy Trial- Day 12

Witness #64- Daniel Lawler- Called by prosecution

Mass. State Police sergeant

  • Lawler testified about his involvement with the search of the Clancy residence.

    • He was responsible for documenting and handling evidence collected during the investigation.

  • Items of Lindsay's clothing were shown/introduced as evidence, including clothing with blood staining.

  • His testimony helped establish the chain of custody and investigative process surrounding physical evidence

  • At one point he went to the hospital as part of the investigation and

    • He was outside Lindsay's room when a psychiatrist entered to speak with her.

    • Lawler did not hear the conversation.

  • During cross-examination, Reddington specifically identified the psychiatrist in question as Dr. Paul Zeisel. A Psychiatrist for the defence.

  • The prosecution has suggested that Lindsay's claim about hearing a voice was something that emerged after the killings, rather than evidence that she was experiencing psychosis at the time.

  • Lawler was questioned about investigators discussing that possibility.

Witness #65- Latiesha Dukes- Called by the Prosecution

Licensed Mental Health Worker at South shore perinatal

  • Dukes provided Lindsay with therapy during December 2022.

  • She was part of the perinatal behavioural health system same as Nurse Jollota.

  • Lindsay had already been seeing other providers, including psychiatrist Jennifer Tufts and psychiatric nurse practitioner Rebecca Jollotta before seeing Latiesha Dukes.

  • Dukes testified that she was not aware of everything the other providers were documenting or treating

  • Dukes testified about Lindsay experiencing:

    • Emotional numbness.

    • Depression and anxiety.

    • Difficulty coping.

    • Significant distress surrounding motherhood.

    • Passive suicidal thoughts.

    • Concerns about her medications, particularly benzodiazepines.

    • Significant weight loss.

  • but continued to say she had "no concerns" about Lindsay's well-being based on what she observed in their sessions

  • Testified she didn't review Jollotta's notes

Opinion time:

Oh My God. This testimony was something. as I was listening to it i was very confused as i'd hear Lindsay symptoms and concerns and then here that Mrs. Dukes had no concerns...... I even went back over the transcript of the live feed thinking I missed something but NOPE. Also she never reviewed Jollota's notes......
They weren't simply two unrelated doctors at two different practices.
They were colleagues within the same perinatal behavioural health program, treating the same patient during roughly the same period.
And yet, according to Dukes she did not necessarily have access to or review everything Jollotta had documented about Lindsay. UMMMM...... HOW DO YOU NOT HAVE ACCESS? Other doctors who were asked about reviewing previous records have also said they didn't have access and would have had to ask Lindsay to sign a consent form to release..... but they were from different clinics, some being private practice.....so it's a bit more understandable but working in the same building, same program, approaching stuff as a "team" you have no access?????? Also the way she testified with such confidence...... she seems nice but it seems like she should have been more concerned at some point even if it was when testifying in the case.

Am I out to lunch to think they would have access to each others notes on the same patient??

  • Yeah man, they don't share. This is Normal.

  • NO, SHARING IS CARING. This is messed up.

Witness #66- Cameron Daley- Called by the Prosecution

duxbury police officer

  • Asked to report to Brigham Hospital for Patient watch of Lindsay Clancy on Jan 25th. She was asleep, with medical equipment attached and staff tending to her. no one other then staff went in the room.

Not sure what the point of his testimony was... all I can think is Cool Story Bro.....

Witness #67- Nicole Bradley- Called by the prosecution

Assistant deputy superintendent field services

  • They do what's called hospital watch which is where they send officers to the hospital to watch over a detainee or inmate

  • All activity of coming and going is logged

  • She verifies log for Lindsay so it can be entered into evidence.

Witness #68- Dr. Renee Stonebridge

Pathologist- Chief medical examiner office

  • Her main focus is cardiac and Neuropathology, Essentially takes a closer look at heart's and brain's

  • Examined Cora Clancy's Eyes, her conclusions of the hemorrhages found indicated an injury consistent with strangulation.

  • Examined Dawson's Eyes as well, note the same type of hemorrhages and Cora Clancy for the same conclusion

  • Callen Clancy examined the brain, dura and spinal cord, Observations:

  • an incident were for a period of time blood and oxygen were not going to the brain

  • Note brain swelling and compression of ventricles from brain swelling preventing cerebral spinal fluid getting into the spine.

  • Testifies it takes 6-8 minutes for the brain to die from lack of blood and oxygen

NO CROSS, SHORT RECESS

Lindsay clancy saying she can't do this anymore
Her testimony is very blunt while using everyday and medical terms at one point she was describing the process she does with the brain and explaining how she puts it in a fluid to help harden because the brain is very soft and "it's very easy to put your fingers in it". Lindsay became extremely emotional during this testimony and it appeared Reddington tried to keep this from being necessary but not contesting the findings but the prosecution decided to go ahead with it anyway. they took a short recess for Lindsay to calm down.

Witness #69- Dr. barbara Olson

Pathologist with the Chief medical Examiner

  • Discusses the Autopsy process from document review to chest incision and organ review.

  • Cora Observation

    • Signs of medical intervention, Intubated, EKG pads and defibrillator pads

    • Iv in the bone of the leg,

    • trauma of the neck called ligature Ferro

    • injuries to her head

    • Police evidence bags around hands

    • minor injuries to her right arm and legs as well

Lindsay breaks down during this testimony as well and a couple minutes in vocalizes " i can't do this". the judge send the jury out for a recess again and two people are seen trying to help Lindsay

kevin reddington objecting

  • Prosecution gets her to identify and point out all injuries in photos taken at the time of the exam to be entered in to evidence

  • Prosecution relates Inter-cranial pressure to a balloon filling up and she agrees.

  • Explains it would have an element of pain until the point of unconsciousness

  • Notes a person will become unconscious in the 10-30 second range with brain damage starting at the 1 minute mark and irreversible brain damage and ultimately death in as early as 5 minutes

Prosecution continues to ask similar questions in different ways or ask for explanations where not needed. Defence is objecting and at one point it is sustained and the judge says they've had that answer. She replies "It's a inconsistent statement" and which the judge points out it's one of their witnesses and she says "I know and i can Impeach on an inconsistent statement" the judge then calls sidebar

  • Dr. Olson is then asked about Dawson Clancy and the process essentially begins again as she describes the similar injuries and conclusions while identifying photos of the exam.

I know people will say she deserves having to sit and listen to this and that it is an appropriate punishment given the crime. and while I don't deny that listening to this was part of the consequences ......watching it on live feed felt like watching someone be tortured while her lawyer sat there unable to help even though he tried.
