the Judge warns jury of emotion provoking images and reminds jury that they must not be swayed by the emotion but rather stick to medical facts. Lindsay had her hands over face and cried during this whole testimony, she tried to keep it quiet but towards the end it was becoming quite auditable. Jury is sent home for the day

My opinion overall today: Went through a lot of witnesses but they all seemed to help the defences claims that Lindsay was a great mother who loved her kids and never wanted to harm them.

The prosecution talked A LOT about things like:

Could Lindsay Communicate

Could She understand things

Did she have any slurred speech

Any odd behaviours

Claim to hear any voices

Express suicidal or Homicidal thoughts.

I think they were trying to imply that because she wasn't showing obvious signs of a Psychotic break, she couldn't have one but unfortunately I think it made the jury see Lindsay as a great mother who was trying to get help.

Conversations without the jury

At the end of the day, there was a significant discussion between the judge and attorneys concerning the prosecution's characterization of Lindsay's suicide attempt.

The judge indicated concern that the prosecution's questioning could be interpreted as suggesting that Lindsay's suicide attempt was fake.

The Commonwealth clarified its position:

  • It was not claiming Lindsay didn't seriously intend to die.

  • It was not saying the suicide attempt was fake.

  • Instead, the prosecution was arguing that the methods she chose were unlikely to accomplish the intended result, and said its reasoning would become clearer through later medical testimony.

The state is trying to object to certain defence witnesses citing they don't have time to review or prepare a cross examine for the doctors.

The defence counters with saying that it's the prosecutions evidence that the witnesses would be testifying to and that they should know it already and have many staff members who can help them.

the judge can't understand how the prosecution couldn't predict an defence expert on how she went out the window. when the issue of how Lindsay became injured and how she exited the window has been brought up a lot.
