Mid Trial Review- Lindsay Clancy

Alright I just wanted to go over my take away from the case the prosecution presented. For legal purposes this is all just my opinion and not fact.

Prosecution team:

Jennifer Sprague — lead prosecutor and the primary attorney presenting the Commonwealth's case.

Shanan Buckingham — Assistant District Attorney, working alongside Sprague. She delivered portions of the prosecution's opening statement and has questioned witnesses during the trial.

Timothy Cruz — Plymouth County District Attorney. He is the elected DA whose office brought the case, but Sprague and Buckingham are the attorneys actually trying the case in court.

My take away on what they are saying happened:

They think that Lindsay planned this and that she wasn't neccesarily struggling with postpartum but with not having control over her family. She essentially decided she was done with that life. now they don't say it but it is strongly implied even though they deny it, that Lindsay didn't intend to kill herself. That was a cover up and when it didn't work she used Psychosis as a reason.

Did they prove this:

Honestly, I found half the witnesses they had to be redundant and not neccessary. The ones that were necessary seemed to always help strengthen the argument of mental insanity, she was very clearly struggling. Parts of their case I could see how if someone interpreted them in the bits they are could seem like this was cold and malicious. However, when putting all the peices into the bigger picture it seems like this wasn't the case. In the end when they said they rested, my thoughts were not SHE DID IT, SHE"S NOT INSANE. They were very much es she did it but she could have been out of her mind at the time. and that is doubt which as the blogs name reflects the case has to be beyond a reasonable doubt.

Addressing the Patrick Theory:

I don't think he did it, I don't think he thought she would ever actually harm the kids. the following are my rebuttals to the arguments made for his guilt.

  1. The email, when he was on the stand it was brought out that it was sent from his phone and there is also a case of sometimes emails take a while to send.

  2. The affair, I don't think he was having an affair. could he have known this new wife prior, sure but knowing someone and sleeping with someone are two different things. I think if he had an affair there would have been digital evidence (phone, computer) and in this case the prosecution would have used it to say "Lindsay found out and did this in revenge". It would have provided a much stronger case for them

  3. Moving on so fast, this one I will agree on the fact that it does seem fast for him to have remarried and had a child. However, this incident happened in January of 2023, this means it's been 3 years but in reality we are closer to the 4 year mark then the 3 year mark. And some people who have been widowed will have remarried and started fresh in that time. Data actually shows that young widowed women tend to wait longer (3 to 4+ years) compared to young widowed men, who remarry in a median time of 1.7 to 3 years. Now I know Lindsay is still alive but the Lindsay he knew and was married to isn't the same one on trial and i think they are both aware that they would never be together again with all thats happened, so in a sense that relationship and person he knew are dead to him. Now if it was me I think knowing how public the case is and the trial was upcoming that I would have maybe waited until after but you never really know how you would be until it's you in a situation.
